Terms of Use

See also our Privacy Policy.

These Terms of Use (the "Terms") govern your use of zezepayments.com and the tools on it (the "Site"), operated by ZEZE, LLC, an Arizona limited liability company ("ZEZE," "we," "us"). By using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

These Terms cover the Site only. Merchant processing services are provided under a separate merchant processing agreement with ZEZE and its processing partners, which controls if it conflicts with anything here. Partner relationships are governed by the Independent Sales Representative Agreement or Referral Partner Agreement you sign with ZEZE.

1. Who may use the Site

The Site is for businesses and the people who run them. You must be at least 18 and able to enter a binding agreement on behalf of the business you represent. By submitting a form, you confirm that the information you provide is accurate and that you are authorized to provide it.

2. Estimates, quotes, and information are not offers

The savings estimator and the "Find your setup" tool give estimates. They are calculated from the figures you enter and from typical pricing assumptions that we publish on the page, and they are not a quote, a rate commitment, or a guarantee of savings. Your actual pricing is set out in a written quote after we review your processing statement, and in your merchant agreement.

Pricing shown on the Site (plan descriptions, example calculations, equipment prices) is for information and may change. Equipment prices are the price of a device if purchased outright; who pays for equipment, and any equipment ZEZE provides at no charge, is confirmed per merchant in writing. Statements on the Site about competitors are drawn from their published terms as of the date shown and may have changed.

Nothing on the Site is legal, tax, or financial advice. Whether a pricing program such as dual pricing is right for your business, and how it must be disclosed to your customers, depends on your location, your card mix, and the card networks' rules; we will walk you through those requirements before you go live.

3. Applications and approvals

Submitting a pre-application, statement, or inquiry does not open a merchant account or create any obligation on ZEZE to provide services. Every merchant account is subject to underwriting and approval by ZEZE and the processing partner and sponsor bank that will hold the account, in their discretion. "Same-day approval," "next-business-day funding," and response-time commitments on the Site describe our usual service levels; they are goals we work to meet, not contractual terms, and funding is subject to the processor's and bank's schedules, weekends, and holidays.

4. Our promises

Where the Site says ZEZE has no contracts, no early-termination fee, no monthly minimum, no PCI fee, and no rate increases, those describe the terms ZEZE offers to its merchants and are written into your merchant agreement. "No rate increases" means ZEZE does not raise its own pricing; the interchange and network fees set by the card networks are passed through at cost and may change when the networks change them.

5. Your responsibilities

You agree not to:

  • submit false, misleading, or someone else's information, or upload documents you have no right to share;
  • use the Site to harass, spam, or scrape, to send automated form submissions, or to probe, overload, or interfere with the Site or its security;
  • copy, republish, or create derivative works from the Site's text, design, illustrations, code, or data except as these Terms allow;
  • use the Site in violation of any law, card-network rule, or third party's rights.

We may limit, suspend, or block access to the Site for anyone who violates these Terms.

6. Uploads

When you upload a statement, quote, driver's license, voided check, or other document, you give ZEZE permission to store it, review it, and share it with the processing partners and sponsor banks described in the Privacy Policy for the purpose you submitted it. You keep ownership of your documents. We store and delete them as the Privacy Policy describes.

7. Intellectual property

The Site, including its text, design, logos, illustrations, animations, code, and data files, is owned by ZEZE or its licensors and is protected by copyright and trademark law. "ZEZE," "payments made zeze," and "Dual-Pricing by ZEZE" are marks of ZEZE, LLC. Other product and company names on the Site, including the names of point-of-sale systems, terminals, and software we install, are the marks of their owners and are used to identify their products; their appearance does not imply endorsement of ZEZE by them or of them by ZEZE.

You may view the Site and print pages for your own business use. Any other use requires our written permission.

8. Third-party sites and services

The Site links to websites and services run by others, including our partners and maps. We do not control them and are not responsible for their content, availability, or practices.

9. Disclaimer

The Site is provided "as is" and "as available." To the fullest extent the law allows, ZEZE disclaims all warranties about the Site, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. The estimates and information on the Site may contain errors or be out of date.

10. Limitation of liability

To the fullest extent the law allows, ZEZE and its members, managers, employees, contractors, and partners will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, data, or business opportunity, arising out of or related to the Site or these Terms, however caused and on any theory of liability. ZEZE's total liability for all claims relating to the Site will not exceed one hundred dollars ($100). This section does not limit liability that cannot be limited by law, and it does not apply to the merchant processing agreement, which has its own terms.

11. Indemnification

You agree to defend, indemnify, and hold harmless ZEZE and the persons listed in Section 10 from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from your violation of these Terms, your submission of false or unauthorized information or documents, or your violation of any law or third-party right in connection with the Site.

12. Governing law and disputes

These Terms are governed by the laws of the State of Arizona without regard to its conflict-of-laws rules. Any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction and venue. Before filing, each party agrees to give the other written notice of the dispute and to confer in good faith for fifteen (15) days to try to resolve it. In any action to enforce these Terms, the prevailing party may recover its reasonable attorneys' fees and costs. Each party waives any right to a trial by jury.

13. Changes to the Site and these Terms

We may change, suspend, or discontinue any part of the Site at any time. We may update these Terms by posting the revised version with a new date at the top; material changes will be noted on the Site. Your continued use of the Site after a change means you accept the updated Terms.

14. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; ZEZE may assign them in connection with a merger, acquisition, or sale of the business. These Terms and the Privacy Policy are the entire agreement between you and ZEZE about the Site.
